Welcome to LuxeBake AI, a software-as-a-service (“SaaS”) product operated by Sarvesh Kumar Ramkorun, an individual sole proprietor based in Mauritius, operating under the brand name LuxeStudios (“we,” “us,” “our”). By accessing or using LuxeBake AI, you agree to be bound by these Terms of Service. If you do not agree, do not use the service. 1. ELIGIBILITY & ACCOUNT RESPONSIBILITY You must be 18 years or older to use LuxeBake AI. You are responsible for maintaining the confidentiality of your account credentials. All activity under your account is your responsibility, whether authorized by you or not. 2. NATURE OF THE SERVICE (CRITICAL DISCLOSURE) LuxeBake AI provides AI-generated content, including but not limited to: Recipe ideas and variations Cost estimates and projections Menu concepts Marketing and descriptive content Visual mockups Business suggestions and insights AI Output Disclaimer All outputs are: Automatically generated Provided “as is” Intended for informational, creative, and assistive purposes only LuxeStudios does not guarantee: Accuracy or completeness Food safety, allergen accuracy, or nutritional correctness Legal or regulatory compliance Profitability or business success You remain solely responsible for: Final recipes and formulations Food safety, hygiene, and allergen management Pricing, costing, and margin decisions Compliance with all applicable laws and regulations Business outcomes of any kind 3. GLOBAL USE & COMPLIANCE RESPONSIBILITY LuxeBake AI is offered globally. You acknowledge that: Laws and regulations vary by country and region You are solely responsible for compliance with local laws, including but not limited to food safety regulations, labeling and allergen requirements, tax obligations, and consumer protection laws LuxeStudios makes no representation that the service or outputs comply with the laws of any specific jurisdiction. 4. SUBSCRIPTIONS, BILLING & PAYMENTS LuxeBake AI operates on a subscription basis. Subscription fees are billed in advance, monthly or annually. Prices, features, and plan limits may change with reasonable notice. All payments are processed by third-party payment providers acting as Merchant of Record. Failure to process payment may result in restricted access, suspension, or termination. 5. USAGE LIMITS & FAIR USE Each plan includes defined usage limits (e.g. recipes, scans, PDFs, mockups). Unused credits do not roll over. Credits reset each billing cycle. Automated usage, scraping, resale, or redistribution of outputs is prohibited. We reserve the right to limit, throttle, suspend, or terminate accounts that abuse the service. 6. NO GUARANTEE OF RESULTS We make no guarantees regarding revenue growth, cost savings, customer acquisition, or business performance. Use of LuxeBake AI does not guarantee any financial or commercial outcome. 7. INTELLECTUAL PROPERTY LuxeBake AI, its software, branding, and infrastructure are owned by LuxeStudios. You retain ownership of your original inputs. AI-generated outputs may be used commercially by you; however: Outputs are non-exclusive Similar outputs may be generated for other users 8. PROHIBITED USE You may not: Reverse-engineer or attempt to extract source code Use the service for illegal, deceptive, or harmful purposes Misrepresent AI outputs as professional, legal, or regulatory advice Interfere with system security or performance 9. SUSPENSION & TERMINATION We may suspend or terminate your access: For violations of these Terms For abuse, fraud, or misuse For non-payment At our sole discretion, with or without notice No refunds are issued for terminated accounts except where required by applicable law. 10. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, LuxeStudios shall not be liable for indirect, incidental, consequential, or financial losses, including loss of profits, revenue, data, or business opportunities. Our total liability shall never exceed the amount paid by you during the most recent billing cycle. 11. GOVERNING LAW & JURISDICTION These Terms shall be governed by and construed in accordance with the laws of Mauritius.
